TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern the access to and use of the website and services provided by NETCORE WEB SERVICES ("we", "us", "our", "Service Provider").

By accessing, registering, purchasing, or using any service from freedomain.co.in, you ("Client", "User", "You") confirm that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree, you must immediately discontinue use of our services.

1. BUSINESS STATUS

NETCORE WEB SERVICES operates as a sole proprietorship business based in India and provides web-related services subject to these Terms and applicable Indian laws.

2. ELIGIBILITY

By using our services, you confirm that:

  • You are at least 18 years of age
  • You have legal capacity to enter binding agreements
  • You are not prohibited from using these services under any applicable law

We reserve the right to refuse service where use poses legal, security, financial, or compliance risk.

3. ABSOLUTE DISCRETION (CORE DEFENCE)

We retain absolute discretion to determine:

  • Whether a service is being used in compliance with these Terms
  • Whether an activity is fraudulent, abusive, illegal, or risky
  • Whether a service threatens infrastructure, compliance, or reputation

Our determination shall be final and binding, subject only to applicable law.

4. SERVICES

Services may include, but are not limited to:

  • Domain registration and management
  • Web hosting (shared, VPS, server-based)
  • Email hosting
  • SSL certificates
  • Website tools and technical support

All services are provided on an "as-is" and "as-available" basis. No guarantee of uninterrupted availability is provided.

5. ACCOUNT RESPONSIBILITY

You are solely responsible for:

  • Maintaining confidentiality of account credentials
  • All activity conducted under your account
  • Accuracy of contact, billing, and identity information

Any activity originating from your account is deemed authorized by you.

6. ACCEPTABLE USE POLICY (AUP)

You agree NOT to use our services for any unlawful, abusive, or prohibited activity, including but not limited to:

  • Fraud, phishing, scams, impersonation, or deception
  • Fake loan, investment, crypto, or payment websites
  • Malware, viruses, trojans, botnets, exploits, or hacking tools
  • Identity theft or misuse of personal data
  • Copyright or trademark infringement
  • Spam, mass emailing, or abuse of network resources
  • Cryptocurrency mining or excessive CPU/RAM/Disk usage
  • Content involving minors, violence, terrorism, or hate speech
Strict Liability for Use: Violation applies regardless of intent or knowledge. Claims such as "I didn't know", "someone else did it", or "developer fault" do not exempt responsibility.

7. DOMAIN SERVICES

  • Domain services are governed by registry and ICANN policies
  • Domain registration and renewal fees are non-refundable
  • We are not responsible for trademark disputes or ownership conflicts
  • Failure to renew may result in permanent domain loss
  • Domain transfers may require additional verification and fees

8. PAYMENTS & BILLING

  • All services are billed in advance
  • Prices may change for renewals or new orders
  • Applicable taxes are charged as per Indian law
  • Late or failed payments may result in suspension or termination
  • Payment disputes or chargebacks may trigger immediate suspension

9. NO-REFUND OVERRIDE (CRITICAL)

Notwithstanding any other clause, offer, communication, or expectation:

NO REFUND SHALL BE ISSUED UNDER ANY CIRCUMSTANCES if a service is suspended or terminated due to:

  • Fraud, scams, phishing, or deceptive practices
  • Malware, hacking, or cybercrime activities
  • Fake financial, investment, or loan schemes
  • Abuse of payment systems or chargeback fraud
  • Violation of law, regulation, or third-party rights
  • Abuse reports or flags from banks, registrars, ISPs, CERT-In, or payment processors
  • Risk-based or suspicion-based suspension

In such cases:

  • All fees paid are forfeited
  • Remaining service period is void
  • No partial or full refund will be provided
  • This applies even if suspension occurs shortly after activation

10. SUSPENSION WITHOUT PROOF

We may suspend or terminate services without prior notice or refund based on:

  • Reasonable suspicion
  • Third-party reports
  • Security or compliance alerts

We are not obligated to provide logs, evidence, or justification to the client before or after suspension.

11. DATA DELETION

Upon suspension or termination for any reason:

  • All data may be permanently deleted without recovery
  • We are under no obligation to retain, export, or restore data

You are solely responsible for maintaining backups.

12. CHARGEBACKS & PAYMENT DISPUTES

Initiating a chargeback or dispute without first contacting support constitutes a material breach of these Terms.

If a chargeback is initiated:

  • Services may be permanently terminated
  • Data may be deleted
  • Administrative or recovery fees may apply

We may submit these Terms, invoices, logs, and usage records as evidence to payment processors.

13. COMMERCIAL USE ACKNOWLEDGEMENT

You acknowledge that:

  • Services are provided for commercial / technical purposes
  • They are not essential consumer goods
  • Certain consumer-protection provisions may not apply

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • Total liability shall not exceed fees paid in the preceding six (6) months
  • We are not liable for losses arising from suspension, termination, or refusal of service

15. INDEMNIFICATION

You agree to indemnify and hold harmless NETCORE WEB SERVICES from any claims, losses, damages, or expenses arising from:

  • Your use of the services
  • Your content or activities
  • Violation of laws or third-party rights

16. LAW ENFORCEMENT & DISCLOSURE

We may suspend services or disclose information when required by:

  • Court orders
  • Law-enforcement agencies
  • Government or regulatory authorities
  • CERT-In or similar bodies

17. COMMUNICATION RESTRICTION

All official communication must occur via registered email or ticket system. Messages via social media, messaging apps, or third-party platforms are not recognized.

18. NO RELIANCE

You acknowledge that:

  • You have not relied on verbal statements or advertisements
  • Only these written Terms govern the relationship

19. WAIVER OF COLLECTIVE CLAIMS

You waive any right to participate in:

  • Class actions
  • Group complaints
  • Representative proceedings

All claims must be brought individually.

20. SEVERABILITY & SURVIVAL

If any provision is held unenforceable, remaining provisions remain valid. Clauses relating to payments, refunds, liability, indemnity, and jurisdiction survive termination.

21. GOVERNING LAW & DISPUTE RESOLUTION

  • Governed by the laws of India
  • Disputes resolved through binding arbitration
  • Arbitration seat: Kolkata, West Bengal, India
  • Language: English
  • Courts at Kolkata have exclusive jurisdiction where applicable
